Welcome to DISHCOVER AR, a web-based augmented reality (AR) food menu platform for restaurant businesses integrating generative AI for 3D modeling. By accessing or using the platform, you agree to these Terms and the accompanying Privacy Policy, in compliance with the Data Privacy Act of 2012 (RA 10173).

PART I - TERMS FOR CUSTOMERS

1. Services for Customers

DISHCOVER AR allows customers to view restaurant menus using AR-based 3D food visualizations, access dish details (ingredients, allergens, pricing), and place orders online where available.

AR visuals are intended to enhance understanding and confidence when ordering but may not exactly match the final food presentation.

2. Customer Responsibilities

By using the platform, customers agree to:

• Use the system only for lawful and legitimate purposes

• Provide accurate information when placing orders

• Respect restaurant policies and ordering procedures

Customers acknowledge that final food preparation, pricing, and service quality are the responsibility of the restaurant.

3. Ordering and Transactions

DISHCOVER AR serves as a digital facilitation platform only.

All orders, payments, fulfillment, and customer service concerns are handled directly by the restaurant. DISHCOVER AR is not liable for delays, cancellations, or service-related disputes.

4. Data Privacy (Customers)

Personal data collected from customers are processed in accordance with the Privacy Policy and RA 10173. Customers retain full rights as data subjects, including the right to access, correct, or object to data processing.

PART II - TERMS FOR RESTAURANT BUSINESSES / ADMINISTRATORS

1. Business Registration and Verification

Restaurant owners or authorized representatives must register an account to access administrative features. Business information such as restaurant name, contact details, and DTI certificate may be required for verification purposes.

Administrators are responsible for safeguarding their login credentials.

2. Use of Admin Dashboard

The admin dashboard allows restaurants to:

• Manage menu items, prices, ingredients, and availability

• Upload food images and 3D models

• Utilize Generative AI tools for 3D food modeling

• Monitor orders and system analytics

All content entered must be accurate, truthful, and updated regularly.

3. Generative AI and AR Content Disclaimer

AI-generated 3D models are visual approximations created based on uploaded images. Restaurants acknowledge that AI-generated outputs may vary in detail and accuracy.

Restaurants remain fully responsible for customer expectations, allergen disclosures, and actual food presentation.

4. Intellectual Property

Restaurants retain ownership of their uploaded content (menus, branding, images). By uploading content, businesses grant DISHCOVER AR a limited license to display and process such content solely for platform operation.

5. Data Privacy (Businesses/Admins)

Business and administrative data are processed in compliance with RA 10173. Upon account deletion, data may be retained for up to 30 days for legal and system maintenance purposes, after which it will be permanently deleted unless required by law.

PART III - TERMS FOR RESTAURANT BUSINESSES / ADMINISTRATORS

1. System Availability and Modifications

DISHCOVER AR is provided on an “as is” and “as available” basis. Features may be updated, modified, or discontinued to improve performance, security, or legal compliance.

2. Limitation of Liability

DISHCOVER AR shall not be liable for indirect, incidental, or consequential damages arising from platform use, including inaccuracies in restaurant-provided content or AR representations.

3. Dispute Resolution (Hybrid Model)

• Parties agree to attempt informal resolution first.

• Minor technical or service-related disputes shall proceed to arbitration under Philippine arbitration laws.

• Unresolved or major disputes (including data privacy concerns) shall be brought before the proper courts of the Republic of the Philippines.

4. Governing Law

These Terms are governed by the laws of the Republic of the Philippines.

5. Changes to These Terms

Users will be notified of material changes prior to effectiveness. Continued use of the platform constitutes acceptance of updated Terms.

DishCover AR is an augmented reality platform designed to allow users to view restaurant menus through 3D augmented images. We are committed to providing a high-quality experience while protecting the privacy and security of our user’s personal information. 

In line with the Republic Act No. 10173, also known as Data Privacy Act of 2012, this privacy policy will explain how the platform collects,processes, protects, and disclose your personal information during transactions and when users avail our services.

1. Collection of information

In accordance with the Data Privacy Act of 2012 upholding the principle of data minimization. DishCover AR strictly collects information that is necessary and relevant to the provided services, ensuring that data is processed lawfully, and transparently. This includes the following:

1.1. Personal Information

When you use our platform, we collect personal information such as name, email, and password. These are necessary to fully access the services that we offer. 

1.2. Business Registration

Upon registering your business to avail our services, you are required to provide the following information such as the restaurant name, contact number, owner valid ID, and your DTI certificate to validate the legitimacy of the business. 

Other than that, you can also customize your restaurant's branding and design within the platform to align with your brand identity. 

Take note: All information provided is used solely for business verification and account set up. Rest assured that this will be handled with utmost care and in accordance with the applicable data privacy laws.

1.3. Camera Access

This platform may request access to your device's camera, particularly with mobile and tablet to access the Augmented Reality (AR) feature by scanning QR codes. Camera access is used only when necessary and is activated solely upon user permission. 

1.4. Admin Dashboard

The admin dashboard collects information entered by the administrator to manage the restaurant menu. This includes product names, categories, prices, ingredients, descriptions, product variations, 3-D model of dishes, and other relevant details in the menu. Hence, all information collected is used solely for managing and displaying restaurant products within the platform.

2. Use of Information

DishCover AR is committed to providing high-quality services and using your information responsibly. This will be done when necessary and for the following purposes:

1.1. To Manage Your Account

To fully access our platform, you will need to register an account. With that, we collect and use your personal information to successfully register your account.

1.2 To Verify Business Registration

When you register your business, the information collected such as your restaurant name, contact number, and DTI certificate is used to verify and confirm the legitimacy of your business and to set up your account on the platform that will be automatically set and recognized as the administrator account.m

1.3. To Enable Customization

During business registration, we use the branding and design information to allow you to customize your restaurant's visual appearance, ensuring it aligns with your brand identity. 

1.4. For Announcements and Updates

We may use your contact information, such as email address to deliver important announcements regarding your accounts, business registration, stem updates, new features, etc. that are available on the platform. 

3. Third-Party Integration

DishCover AR may integrate with third-party services to support and enhance the functionality of the platform, specifically the generation and rendering of 3D models for the product items. These third parties may process limited personal or business information on our behalf and only for purposes necessary to deliver our services.

4. Data Retention

Upon account deletion, DishCover AR may retain your personal and business information for a period of 30 days to comply with the legal requirements and ensure proper system maintenance. After that, rest assured that all your data, including your PII and business information will be permanently deleted from our platform. 

5. Disclosing Information

When required by the applicable law, DishCover AR may disclose your personal information when availing our services. This clearly means that we may use your personal data inline with the Data Privacy Act of 2012. Rest assured that your personal information is handled properly and can only be disclosed when necessary.

6. Changes to the Privacy Policy

We may update our privacy policy from time to time. This periodic change enhances the overall security of your personal information, collection and use of your data, terms and conditions, legal requirements, and for other reasons that may be. Therefore, we highly encourage you to review and understand this privacy policy from time to time. Take time to analyze the changes and updates as it may deem necessary from both ends.

If there are any changes to the privacy policy, we will notify you through emails and a notice coming from our website. 

Take note: This will be done before the implementation of the updated privacy policy. You have the right to decline and agree to these changes by means of discontinuing or continued usage of our platform and services. Whatever may the outcome be, we will respectfully understand and respect your decision. 

7. Your Rights Under the Data Privacy Act

As a data subject, you have the following rights under the Data Privacy Act:

You have the right to be informed of the collection and processing of your personal information, as this information may be disclosed to the public — shared to others, when necessary. Therefore, you are required to read and understand this privacy policy before giving your consent.
